100% Tax on Non Resident, Non EU Citizens – Updates.

Spain's government have yet to give any detailed information about their recent proposal to impose a 100% tax on property purchases by non-EU non-residents however, in the absences of concrete details, there are many opinions being offered. In this post I will look at some of the arguments from both sides of the table, but first, let's remind ourselves of the government's motivations. 

Government's Rationale

Prime Minister Pedro Sánchez introduced the tax as a measure to address escalating housing prices and limited availability, particularly in urban centers like Madrid and Barcelona. The government contends that foreign investors often acquire properties for investment or vacation purposes, thereby inflating prices and reducing housing options for residents. This initiative aligns with broader efforts to ensure affordable housing and curb speculative practices.

Supportive Perspectives

Proponents argue that the tax could deter speculative investments by foreign buyers, potentially stabilizing or reducing property prices, and making housing more accessible to locals. They highlight similar policies in countries like Canada and Denmark, suggesting that such measures can be effective in cooling overheated housing markets.

Critiques and Concerns

Critics, however, raise several issues:

  • Legal Challenges: Legal experts caution that the tax may conflict with the European Union's principle of free movement of capital, potentially leading to legal disputes at both national and EU levels.

    Indeed my own knowledge of EU Law (I hold a qualifying law degree) backs up this opinion. EU member states are prohibited by treaty from restricting free movement of capital both within the EU and between the EU and third countries (A63TEU). This appears to include the imposition of excessively high taxes on the purchase of property.

    Whether the EU would agree is another matter however it would take a long time for the case to make its way through the courts to the ECJ.

    Cases take around 20 months on average and, given that the policy has not been enacted yet, this would push implementation beyond Sanchez's current term in office. He may try to force the law through and await a judgement overturning it however this may be politically and financially foolish if the judgement it likely to go against the Spanish Government. 
  • Economic Impact: Some analysts warn that the measure could deter foreign investment, which has been instrumental in revitalizing certain regions. They argue that foreign buyers, who often purchase higher-priced properties, contribute significantly to the economy, and that the tax might have unintended negative consequences.
